The Supreme Court
The Supreme Court of P.E.I. consists of two divisions, the Appeal and Trial divisions.
The Appeal Division hears appeals from the Trial Division, Provincial Court and various administrative tribunals. It also provides opinions on questions of law which may be referred to it by the Lieutenant Governor-in-Council and some administrative tribunals.
The Trial division is the Superior Trial Court for the Province, hearing civil (including family ) and criminal matters, appeals from administrative tribunals and appeals from the Provincial Court. Justices of this division also have jurisdiction over probate and administration of estates matters.
The Provincial Court
The Provincial Court hears criminal matters, offences under other federal legislation as well as offences under Provincial legislation, including the Highway Traffic Act. The judges of the Provincial Court also serve as the judges of the Youth Court.
