Major Legislation Changes
Revisions, in 2005, to the Pesticides Control Act regulations introduced a wide range of improvements related to the sale and use of pesticides. These included:
- Mandatory Pesticide Vendor Business License for a company that wishes to sell Commercial class or controlled-purchase Domestic class pesticides
- Mandatory Pesticide Application Business License for a company that wishes to apply a pesticide
- Creation of new category-specific applicator classes, and corresponding examination/certification requirements
- Minimum loader/mixer certification to prepare pesticide tank mixes
- Mandatory record keeping for the application of a non-domestic pesticide
- Strengthened notification and posting requirements for all non-agricultural pesticide applications
- Mandatory testing and certification for vendor sales staff, including those individuals who make recommendations regarding the selection/use of a pesticide
- Ban on all aerial-based pesticide applications
- Ban on pesticide use within designated aquatic buffer zones
- Reduction in legal wind speed (from 25 to 20 km per hour) to apply any pesticide
- Stronger financial penalties for violations
