Barrier Free Design Regulations
The provincial government has developed and approved Provincial Building Code Act and subsequent barrier-free design regulations. These regulations adopt and amend Section 3.7 of the National Building Code of Canada 1990. This Section of the National Building Code provides a mandatory minimum building design standard to ensure that disabled persons have access to particular buildings and designated facilities within buildings. The regulations apply to all areas of the Province except within the geographical boundaries of a municipality which has adopted the National Building Code of Canada.
What is exempt?
Also, the following are exempt:
- farm buildings
- houses, including semi-detached, duplexes, townhouses, row houses, boarding houses, mobile homes and summer cottages
- buildings that are ancillary to houses, including semi-detached, duplexes, townhouses, row houses, boarding houses, mobile homes and summer cottages
- buildings classified as group F Division 1 major occupancy in accordance with Section 3.2 of the National Building Code of Canada 1990. (This classification of building applies to high hazard industrial occupancies like bulk plants for flammable liquids, dry cleaning plants, feedmills, grain elevators, paint factories, spray painting operations,etc)
- buildings not intended to be occupied on a daily or full-time basis like telephone exchange buildings, pumphouses, substation, baitsheds, etc. and
- apartment buildings of residential occupancy which are not equipped with an elevator if the difference in elevation between the entrance level and every dwelling unit in the building exceeds 600mm.
