Safety Guidelines for the use of 15-Passenger Vans

A 15-Passenger Van is defined under the PEI Highway Traffic Act as a Bus and a Commercial Vehicle.

(a.2) "bus" means any motor vehicle designed for carrying more
than ten passengers, including the driver, and used for the
transportation of persons, and any motor vehicle, other than a
taxicab, designed and used for the transportation of persons for compensation;

142.(b) "commercial vehicle" means a commercial vehicle as defined in
clause 1(b.2) that has a gross mass exceeding 4,500 kg and includes
a bus that has a seating capacity of more than ten passengers;


A Class 4 driver's license is required to drive a 15-Passenger Van under the Driver's Licenses Regulations.

1. The following classes of driver's licenses are prescribed and, subject
to the Act and these regulations, the holder of a driver's license of one of
these classes is authorized to operate only the types of vehicles specified
below for that class:
(d) Class 4 - authorizes a person to drive
(i) any motor vehicle which the holder of a Class 5, 8 and 9 may
operate,
(ii) any ambulance,
(iii) any taxi,
(iv) any bus with a capacity of fewer than 25 passengers;.


The following rules apply to individuals wishing to apply for a Class 4 driver's license:

The applicant must pass an Air Brake written exam and practical test if any Class 4 vehicle operated is equipped with Air Brakes.

2.(1) No person shall operate on a highway a vehicle that is equipped
with airbrakes and that requires a class 1, 2, 3, 4, or 5 driver's license to
operate unless the person holds a valid driver's license that is endorsed
with the letter "A" by the Registrar of the class required for the vehicle.


The applicant must pass pre-check inspection knowledge test and road test in a full size passenger van (15 passenger van or larger) before a Class 4 driver's license will be issued.

3(2) Every applicant for a driver's license shall be tested in a motor
vehicle which
(a) is appropriate to the class of driver's license for which an
application has been made; and
(b) has been approved by the Registrar.


The applicant must submit a medical certificate for approval that shows applicant meets the medical and vision standards to operate a vehicle that requires a Class 4 driver's license.

3(3) The Registrar shall not issue a Class 1, 2, 3, 4, 5, 6 or 8 driver's
license to any applicant who holds a Class 7 license unless the driver
applicant:
(a) has completed
(i) the Novice Driver Course, or
(ii) a driver education course recognized by the Registrar; and
(b) has complied with the medical and vision reporting cycles and
meets the medical standards for Class 1, 2, 3 and 4 as prescribed by
the most recent edition of the manual, Medical Standards for
Drivers, published by the Canadian Council of Motor Transport
Administrators.


Regardless of age, the applicant cannot be in the Graduated Driver License Program.

7.(1) Subject to subsection(2), the Registrar may not issue a Class 1, 2,
3 or 4 driver's license to a person who is a Stage 2 or Stage 3 driver as
set out in the Graduated Driver Licensing Regulations made under the
Act.


Medical Fitness to Drive

Once an individual has received a Class 4 driver's license they must submit an approved medical to operate a Class 4 driver's license according to the medical reporting cycles under the Medical Standards for Drivers, published by the Canadian Council of Motor Transport Administrators. Once every 5 years up to age 45, every 3 years up to age 65 an annually after age 65.

Periodic Inspection of Vehicles

All vehicles defined as a Bus under the Highway Traffic Act are required to be inspected once very 6 months under PEI's Motor Vehicle Inspection Regulations.

3.(1) Subject to subsections (4) to (7), all vehicles in use on the
highway and registered in the province shall pass a periodic inspection
(a) it shall be inspected at least once every 12 months but where the
vehicle is a bus, it shall be inspected at least once every six months;
