Refunds in a Private Training School

A school may have its own distinctive refund policy.
However, the Private Training Schools Regulations (sections 11 and 12) set a number of basic rules which all schools must follow.

Here is a plain-English outline of those rules:

  1. No-show of a student who registered:
     => the school keeps any advance registration fee (max $100)   [ss 11(3)]

  2. If the school does not provide the program when promised:
     => the school must refund the registration fee (the max-$100 deposit)   [ss 11(4)]

  3. If the school starts a program but terminates it before completion:
    1. if this happens before the 1/5 point in the program
       => the school must refund the total of all fees which have been paid
    2. if this happens after the 1/5 point in the program
       => the school must refund the fees which have been paid but are 'unearned'  (i.e. the amount which would cover the part of the program which is yet to be delivered)   a sort of bonus equal to 10% of total fees which the student has paid   [s 12]

  4. If the school expels a student for just cause:
     => the school may keep the 'earned' fees   (i.e. what has been paid for the part of the training already delivered)   a sort of bonus equal to 10% of total fees   [ss 11(6)]

  5. If the school expels a student without just cause:
    1. if this happens before the 1/5 point in the program
       => the school must refund the total of all fees which have been paid
    2. if this happens after the 1/5 point in the program
       => the school must refund the fees which have been paid but are 'unearned'  (i.e. the amount which would cover the part of the program which is yet to be delivered)   a sort of bonus equal to 10% of total fees which the student has paid)   [s 12]

  6. If a student formally withdraws (by written notice) before the 2/3 point in the program:
     => the school may keep the 'earned' fees  (i.e. what has been paid for the part of the program already delivered)   a sort of bonus equal to 10% of total fees   [ss 11(6)]

  7. If a student withdraws but doesn't provide formal notice*, or doesn't provide that notice until after the 2/3 point in the program:
     => the school may keep the entire amount of fees   [ss 11(7)]

  8. If a student withdraws (with or without proper notice) after the 2/3 point in the program:
     => the school may keep the entire amount of fees   [ss 11(7)]

  9. If a student withdraws but is not 'paid up':
     => what s/he owed remains a debt owing to the school, calculated according to 'earned' fees  (i.e. the student owes for the portion of the program that was delivered before s/he quit)   [ss 11(8)]

* If a student withdraws without written notice,
the school sends a registered letter stating that the contract is terminated 30 days after the student quit attending - or if the student never attended, 30 days after the contract's effective date.   [ss 11(9)]

The school must pay any refund within 15 working days of the contract's termination.   [ss 11(10)]

If there has been misleading advertising, or if the school is not registered, then the school is not entitled to keep any fees.   [ss 11(11)]
