Land Identification Program
Land may be "identified for non-development use" as a condition of approval pursuant to Section 4 or 5 of the Lands Protection Act when a non-resident person or a corporation (regardless of residency) acquires land or when the Crown or one of its agencies conveys land to another party.Land identified for non-development use cannot be used for commercial or industrial purposes or subdivided unless the owner first receives approval to amend, cancel or suspend the identification restriction.
Land remains identified for non-development use indefinitely unless the owner files a Notice of Termination of Land Identification Agreement.
If you are considering purchasing land on Prince Edward Island, search the Island Regulatory and Appeals Commission database to find out if the parcel has been "identified." You will need the parcel number of the property to complete this search.
The Lands Protection Act is online as a PDF document.
