PROPOSED REGULATIONS

This is to provide public notice and to request comments on Regulations proposed for adoption under the new Securities Act.

The Regulations deal with two matters:

  • publication requirements for rules made by the Minister under section 168 of the Act, the effective date of such rules and adoption of forms under the rules;
  • costs recoverable by the Superintendent for investigations, hearings and reviews.

We are proposing to bring sections 1, 13, 168 and 169 of the new Securities Act into force on February 11, 2008 so that we can bring the Regulations into force on that date. This will mean that the publication and effective date requirements for the rules are in place before we bring the rest of the Act and the rules into force on March 17, 2008.

The publication requirements in the new Regulations are similar to the existing publication requirements under the old Securities Act, section 36.
