Access and Amendments

Individuals have a right to access their own personal information that is held by Department.¹

Upon request, subject to applicable legislation, the Department will respond to an individual’s request for their own personal information in line with any time limits and fee schedules outlined, and will:

  • inform the individual if the Department holds personal information about them;
  • provide access to personal information requested. Access may be granted through a variety of means, including but not limited to: direct provision of copies of records; and/or a review of requested records with an appropriate individual;
  • inform the individual of their right to request a review by the PEI Privacy Commissioner of the Department’s decision regarding release of their personal information.

Individuals may request corrections to their personal information that is held by the Department. Upon request, the Department will:

  • determine if the requested change(s) may be made in accordance with existing legislation and organizational policy. Under the Freedom of Information and Protection of Privacy Act, the Head of the public body may correct the information if it is factual, however, the Head of the public body cannot correct or alter an opinion;
  • inform the individual of its decision and of what steps, if any, have been taken;
  • inform the individual of their right to request a review by the PEI Privacy Commissioner of the Department’s decision regarding correction(s) to their personal information.
